How can he violate that clause if he is not President yet? You cannot convict someone of a crime that has not yet been committed. No one gave Donald Trump any gifts while he was President of the United States because he hasn't been President of the United States, and he won't be President of the United States until he I sworn in on the steps of the US Capitol building at 12:01 pm on January 20, 2017. All of Trump companies are privately held, they are not required to publicly publish their tax returns, there are no stockholders in Trump's companies, they are family businesses, Much as SpaceX is, you cannot buy stock in SpaceX.

The president will attend the Red Cross Ball at his Mar-A-Lago estate, and a Super Bowl party at his Palm Beach golf resort And Both Benefit His Businesses. Given that Trump earns income from both of these properties, his decision ― as president ― to attend events there creates the appearance that he may be using the presidency to increase the visibility, prestige and financial value of his clubs.

Tom Kalbfus and kbd512 my other posts was intended to give information to the post and not to discredit as I needed to look up details for what you were talking about as I was not in the know of these stated facts.

For clinton all I ever heard was her emails to which that was only the half truth as the generals and cia that informed her are just as guilty to giving arms and uranium to our enimies to which you do not appease with gifts to expect good behavior. They should all go up on charges. She was there patsy to take the fall for by being a yes man playing good solder and not thinking about the consequences of the action.

The rioters, looters, racists have been both pro-Trump and anti-Trump all through out the campaign and now even after commiting crimes to which they all should be punished. Like you summed up Obama did not have any of this for or against. So why is that......

There is a firestorm coming to this nation as we become more devided and are undermining the court of this land to which is one of the balancings of power that the founding fathers for saw was needed to keep monarchy control from happening.

It’s not just Donald Trump feuding with the courts. States are doing it, too.

As President Trump escalates his confrontation with the judiciary branch in tweets and speeches, lawmakers in some half a dozen states are testing their state courts' independence with actual legislation.

Bills have been proposed in Florida, Washington state and Idaho to allow those legislatures to override certain court decisions. In Arizona, the House passed a bill that would give the legislature the power to prohibit state courts from enacting federal court decisions. A series of bills are advancing in Oklahoma to increase the legislature's power over the courts, including a retirement-age restriction that would effectively wipe out most judges currently serving on the state's appeals court.

The trend is also alive in Wyoming, where a bill to strip the courts of the power to hear any cases involving K-12 education funding recently passed the state Senate. Most of these bills are championed by Republican lawmakers in Republican states. But in Hawaii, where every state senator is a Democrat, a bill is advancing to give the Senate power to decide whether to reconfirm judges for multiple terms in office.

So be prepared for crime to continue to increase as there is no penaly for committing it as the protection via the constitution is erroded by those passing legislation barring it.

"This notion that a legislature can just override a court ruling is quite radical," said Alicia Bannon, who is with the nonpartisan Brennan Center for Justice. "What this does is really shift power toward political institutions in a way I think should make people worried about the ability of courts to enforce the Constitution and protect people's rights."

Judge to Trump: No protection for speech inciting violence lawsuit by three protesters who say they were roughed up by his supporters at a March 1, 2016 rally in Louisville, Kentucky. They argued that Trump didn't intend for his supporters to use force.

Two women and a man say they were shoved and punched by audience members at Trump's command. Much of it was captured on video and widely broadcast during the campaign, showing Trump pointing at the protesters and repeating "get them out." Judge David J. Conservative members want to get rid of regulations imposed on insurance companies that they say drive up the cost of health care but ensure that sick people maintain health care that covers an array of procedures and preventative care.

Moderates, meanwhile, are opposed to stripping the regulations, concerned that too many people would lose coverage and that the cost for sicker and older people would become too great.

Congress will return from recess with a crowded agenda that starts with the need to pass a funding measure to prevent a government shutdown. They'll also have to consider a debt ceiling increase and would like to also tackle tax reform.

You have a point. Trump appears determined to get himself impeached. One issue is business ethics and government ethics are often in complete conflict. In business, you always find a way to make profit. If you broker a deal between two other parties, find a way that you profit yourself. A condition for closing a big deal could be a discount for a second, smaller deal. But the big business deal could be between the other parties (individuals or business), but the second smaller deal is for yourself. For the second party, that means big profits for the big deal, and discount only for a much smaller deal. For them that means profit. For the broker, he makes money through the discount for the small deal. The broker could be someone who doesn't have anywhere near the resources for those involved in the big deal, but the small deal is still very significant compared to what he has. This is normal in business. However, when a President does this, it's called "emoluments". That's a violation of the constitution, and grounds for impeachment.

From a business perspective, if you invest as much money as a presidential election campaign, then you must get direct return on investment that is greater than said investment. For business, it's unethical to not recover your investment. For a President, manipulating government to gain profit above the President's salary is unethical. Trump charging the government for using Trump Tower as an extension of the White House, and charging for vacations to Mar-a-Lago is something that business ethics will absolutely require. Under government ethics, this is a conflict of interest and unethical.

But impeachment requires a simple majority vote in the House of Representatives, then a trial in the Senate with the chief justice of the Supreme Court presiding. The Senate then has to vote 2/3. With a Republican majority in both houses of Congress, that will be difficult.

Current conflicts with Russia: it looks like the US started it. One US political talk show said Putin blames Hillary for 2011-2013 protests in Russia, known by some western media as the Snow Revolution. Putin's current interference with western elections is retaliation. He didn't just interfere in the US, he also did with German, French, British and Dutch elections. (reference) This is tit-for-tat. Hatfield vs McCoy. You can't just demand Russia stop without doing so yourself. Trump wasn't involved in 2011-2013, so he's in a position to end it.

He’s recently banished them from their command post at Trump Tower, and then most recently during his golf vacation in New Jersey. When a Private plane belonging to a Russian billionaire Roman Abramovich, who has very close connections to Vladimir Putin, arrives in New Jersey for Trump’s Golf Vacation President Pushing Secret Service Away. That leads to the burning question of whether Donald Trump is keeping the Secret Service at arms length because he wants to avoid agents witnessing his interactions with anyone who shows up at his golf resort during the course of his current vacation. So is Trump pushing away the Secret Service because he wants to eliminate the possibility of witnesses? .

More than 60 Dem lawmakers demand ethics investigation into Trump's relationship with China following the president's recent push to rescue Chinese telecommunications firm ZTE. ZTE was banned by the Commerce Department from buying tech components after it violated U.S. sanctions by selling equipment to North Korea and Iran.

In the letter, lawmakers say the business dealing between the Trump Organization and China may have violated U.S. laws forbidding public officials from accepting payments or gifts from foreign entities without Congress's approval.

"The Chinese government's loan provides a clear financial benefit to President Trump," the letter reads. "Despite the nearly unanimous recommendation by legal experts that he divest from his business interests before assuming the presidency, he failed to do so, instead placing his adult children in charge of day-to-day operations."

Trump still holds interests in his businesses via a revocable trust - an arrangement that allows him to draw funds at his choosing - the president will be able to oversee the project and "earn a profit if it succeeds," according to the letter.

If Judge Sullivan finds that Mr. Trump has violated the emoluments clause, congressional Democrats can ask for information in the discovery phase of the lawsuit about any foreign benefit related to his global business dealings, including payments, trademarks, intellectual property and regulatory advantages.

“We can look at his books and tax returns in order to determine what emoluments he’s accepted,” Mr. Nadler said. If evidence of financial fraud is found in the course of discovery, Mr. Nadler said that information would be made public and turned over to law enforcement officials.

“This gives Congress an opportunity to invoke our congressional right to make sure that the president is loyal to the U.S. and not to his own pocketbook,” Mr. Nadler said.

He's a Democrat who "#walkedaway" and became a Republican.  That's his major conflict of interest.  He finally recognized that the Democrat Party has absolute nothing to offer the American people in the way of useful domestic or foreign policy.  It doesn't matter if you think that's the problem or not.  I'm here to tell you that "no policy" is the exact problem.  "I hate Trump" is not a policy of any kind.  You can ignore that completely and pretend there is one, choosing to continue this losing strategy, or learn from it and demand your party come up with feasible domestic and foreign policies that are better than the ones President Trump has.

Notice that Emolument is capitalized and present is not.   That strongly implies the more formal of two meanings used at the time.  One, an official fee for an official job, versus any gain whatsoever for whatever, which is almost never, ever used.
