There is no actual treaty banning Nuclear power in space. The issue is public fears that an accident could cause chaos especially on launch.

We have launched many RTG power sources and there has been public protests.

Though on the Moon nuclear is not really a concern we have much more effective source of power in the form of Solar but it will be a source of radioactive materials.

In the previous Admin Trump signed an executive order allowing mining the moon and asteroids, he called the Moon Agreement a "a failed attempt at constraining free enterprise."

The law provides that Japanese private business operators shall be permitted to engage in the exploration and development of space resources, such as water, minerals, and other non-living resources in outer space, on the Moon and other celestial bodies, the Japanese lunar exploration company with a European subsidiary in Luxembourg said.

Even if this crash wasn’t Musk’s doing, as some allege, Musk is still without question the world’s biggest space slob. His Starlink satellites, which beam high-speed internet from satellites, as well as debris from failed missions account for 1,600 close encounters per week, which is when spacecraft come within three-fifths of a mile from each other.
A European satellite had to dodge at the last minute to avoid a collision with a SpaceX satellite when the SpaceX craft refused to change course. SpaceX officials said they didn’t get the email the previous day raising the concern.

In an interview with a German newspaper, Nelson cautioned, "We must be very concerned that China is landing on the Moon and saying: 'It's ours now and you stay out.'" China immediately denounced the claims as a "lie".

This spat between the administrator of NASA and Chinese government officials comes at a time when both nations are actively working on missions to the Moon - and China has not been shy about its lunar aspirations.

Treaty of Zaragoza, also called the Capitulation of Zaragoza (alternatively spelled Saragossa) was a peace treaty between Castile and Portugal, signed on 22 April 1529 by King John III of Portugal and the Castilian emperor Charles V, in the Aragonese city of Zaragoza, the treaty defined the areas of Castilian and Portuguese influence in Asia.
